Vape and nicotine sponsored posts: what's actually allowed
Most sites selling vape guest posts don't mention that promoting nicotine vapes in paid online content is prohibited in the UK. This guide sets out what is allowed, what changes in 2027, and where sponsored content can lawfully run.
Updated 11 October 2026 · Reviewed against TRPR 2016 Part 7, CAP Code rule 22.12, CAP factual-vs-promotional guidance, the Tobacco and Vapes Act 2026 and EU TPD Art. 20(5)
The short answer
Not for nicotine vapes aimed at UK readers. The CAP Code (rule 22.12) and the Tobacco and Related Products Regulations ban online marketing that promotes unlicensed nicotine vapes, and a paid sponsored article on another site counts. Still allowed: nicotine pouch content until the planned advertising ban on 1 June 2027, media aimed exclusively at the trade, and markets where it's lawful, such as the US with FDA warnings. The EU bans it too.
The UK rules, plainly
- Prohibited: marketing in online media, newspapers and magazines that directly or indirectly promotes nicotine vapes, including paid sponsored articles, paid social, influencer and affiliate posts. The ASA has ruled against a sponsored newspaper advertorial that promoted vapes generally, and holds brands responsible for third-party placements.
- Allowed: factual information on your own website and in non-paid space you control (name, ingredients, nicotine strength, price, warnings); media aimed exclusively at the trade; and ads that announce a business exists without promoting products.
- Disposable vapes have been banned from sale across the UK since 1 June 2025.
- Tobacco and Vapes Act 2026: sales of vapes and nicotine products, pouches included, to under-18s are an offence from 29 October 2026, and an advertising and sponsorship ban covering vapes and nicotine products is planned from 1 June 2027.
Placements that can run lawfully
| Placement | UK | EU | US |
|---|---|---|---|
| Nicotine pouch sponsored article (18+) | Allowed until 1 June 2027, under general CAP rules | Varies; some countries ban pouches | Allowed with FDA warning |
| Vape sponsored article promoting products | Prohibited | Prohibited (TPD Art. 20(5)) | Allowed with FDA warning and disclosure |
| Trade-only B2B content | Allowed in trade-only media | Allowed in trade publications | Allowed |
| Regulatory and industry news (unpaid editorial) | Our desks decide; it can't be bought | Same | Same |
A UK-based publisher carrying vape promotion for non-UK readers is a legal grey area; we take those orders only for markets where it's clearly lawful and never for UK or EU audiences.
What vape and pouch placements cost
Published rate data is thin: gig sellers ask $5–$150, vetted vendors around $300–$500, and many vape publishers quote on request. Fewer publishers accept this niche than CBD, so premiums are common. 3rd Unicorn's nicotine titles cost $85 for a mention, $110 to edit your article and $125 for a full article we write, for the placements above that are lawful.
What a compliant pouch or non-UK vape post avoids
- Health or cessation claims such as "safer than smoking", unless the product holds a medicines licence.
- Anything with youth appeal: cartoon styles, sweets and dessert flavours in the foreground, young-looking people.
- Landing pages without age verification.
- Discount codes and giveaways, which regulators treat as promotional.
